Steps for filing FCC comment via EMR Policy Institute

Four Steps to help you write an affidavit to be submitted as part of
The EMR Policy Institute Comment that will be filed inFCC 09-31 Notice
of Inquiry - A National Broadband Plan for Our Future GN Docket No.
09-51


1. Read first in its entirety Helpful Tips for Composing An Affidavit.  
(See below.)

2. Then modify theGeneric Affidavitto your specific situation. As our
attorney advises:


As advocates, we may not put words in peoples' mouths -- especially
sworn statements, which must contain the person's own words -- which is
why it will be extremely important that this is not a 'cookie-cutter'
type affidavit, but a form that can easily be modified by each
individual.


3. Staple all the pages of your document together and take it to a
Notary Public and have it notarized.

4. FAX your document by June 4, 2009 to: 304-932-0022. Mail originals
to: EMR Policy Institute, P.O. Box 117, Marshfield, Vermont 05658


Thank you for taking the time to participate. It is crucial that you
make your voice heard. The FCC needs citizen input to compel it to
address the serious public health problems that will accompany a
nationwide wireless buildout. In FCC Acting Chairman MichaelCopps’
formal statementon this Notice of Inquiry he said:


This Commission has never, I believe, received a more serious charge
than the one to spearhead development of a national broadband plan.
Congress has made it crystal clear that it expects the best thinking
and recommendations we can put together by next February. If we do our
job well, this will be the most formative?indeed
transformative?proceeding ever in the Commission’s history. . .
. . .It will endeavor to better understand, and hopefully build upon,
the cross-cutting nature of what broadband encompasses, beginning with
an appreciation that it brings opportunities to just about every sphere
of our national life. And it can also consider, in addition to the many
opportunity-generating characteristics of broadband, how to deal with
any problems, threats or vulnerabilities that seem almost inevitably to
accompany new technologies. Ensuring broadband openness, avoiding
invasions of people’s privacy, and ensuring cybersecurity are three
such challenges that come immediately to mind. We have never in history
seen so dynamic and potentially-liberating a technology as this?but
history tells us that no major technology transformation is ever a
total, unmixed, problem-less blessing.

HELPFUL TIPS FOR COMPOSING AN AFFIDAVIT

The purpose of this affidavit (which means it is a sworn statement) is to:

A) state your individual and specific concerns about wireless technology
and desire for the setting and enforcement of appropriate safety standards
based on current science;

B) to state your request that EMR PI represent your interests before the
FCC and other bodies considering these issues.  

Starting at the top of this generic form, you will need to:  

tailor it to fit your specific personal facts.  

so,

1. Put your name at the top in the Title.

2. Put your state and your county within the brackets at the top left.  
Leave the "ss." which stands for "solemnly sworn".  

3. Put your name in CAPITAL LETTERS at the top of the statement.

4. Put your name and address in paragraph 1. Number every paragraph.  
Each paragraph should contain a single factual assertion. The reason for
numbering is that it allows lawyers and advocates later to address specific
issues you have raised, and do this easily by reference to specific paragraph
numbers.

5. Number your pages, at the center bottom. Use as many pages as
necessary.  

6. This is not a letter to the editor or an opinion speech. This
document has a purpose, and that is to say who you are, what the specific facts
about your living situation are that inform your concerns, and then what your
concerns are, what you are asking the government to do, and then finally,
indicating your request that EMR PI should advocate on your behalf.  

7. Use as many paragraphs as you feel necessary to tell your whole story
and to indicate the basis for your concerns.  

8. Tell only what you personally know to be true -- as this is a sworn
statement, you can only swear to what you know. Don't guess.  

9. If you have children or parents or other family members who share your
concerns, or about whom you are concerned, describe them in the opening
paragraphs (ie, do they live with you, what are their ages? are they ill or
immune-compromised? state this simply. Ages of minor children and senior
citizens and persons with compromised immune systems or cancer survivors are
of particular importance. Give as much detail as you are comfortable
giving: but recall that this will be a public document, and anything you say
here will be in the public domain. But detail will also make all the
difference in helping to change public policy and possibly the setting of
important safety standards.  

10. You may attach articles and or photographs (say of the tower next to
your home or in your town), or other exhibits to support your specific
concerns.  

11. Be sure to put your own personal name at the bottom on the signature
line.

12. When the affidavit text is complete and you are ready to finalize it,
staple all the pages together at the upper left. (a notary will not sign
loose sheets). Have a form of government-issued photo identification with
you (drivers license is perfect). Have about $5 with you (notaries usually
charge a fee). You can find a notary at your town hall or local bank.  
You will be asked to swear to the truth of everything that you have written
-- it is therefore just the same as sworn testimony in court.  

Don't delay, time is of the essence.
